Delhi HC directs for interim arrangement in JNU GSCASH case, pending complaints to be inquired

On Tuesday, 19th December 2017, the High Court of Delhi with a bench comprising of Justice Sanjeev Khanna and Justice Pratibha M. Singh heard the petition filed by teachers of Jawaharlal Nehru University (Petitioners) seeking quashing of Gender Sensitization Committee Against Sexual Harassment (GSCASH).

The Court had on the previous date of hearing directed that a list of pending cases be prepared and handed over to the Court in a sealed cover since the Petitioners objected to handing over of the pending complaints to the ICC pending final decision and disposal of the writ petition.

The Court on Tuesday(19th December) heard the Petitioners and JNU on the list of pending complaints and objections to the hand over. The Petitioners were represented by Senior Advocate, Ms. Indira Jaising and Advocates Suroor Mander, Radhika Saxena and Aman Pandey. One of the complainants was also present in court, who expressed her reservations with the same. The Court finally directed for an interim arrangement whereby pending complaints are to be inquired into. The inquiry committee would consist of one member from the ICC, one member from GSCASH and one external member to be appointed by the Court.

Though listed for final disposal, the petition was not heard since the Delhi High Court Bar Association was on strike and lawyers were abstaining from work. The petition will now be listed on the 22nd of February 2018 for final arguments.
